NOTE FROM BOB SIEGEL: My comment about the constitution NOT stating that ONLY CONGRESS can declare war had to do with the same constitution also granting discretion to the president as commander-in-chief during times of emergency, a right bestowed upon one branch in tension with the rights of another branch, thus a measure of ambiguity. Men such as Alexander Hamilton argued that the U.S., when attacked, is already in a state of war, and over the years, courts and politicians have sought to expound upon this issue better.
My comment could have been better stated and better clarified. I was (while thinking out loud) trying to recall a law that was passed later which did spell out the separation of powers more concretely. This law is: PUBLIC LAW 93-148-NOV. 7, 1973.
